1. About these terms
These Terms of Service apply when you visit scancards.co or buy products or services from Scan Cards. By placing an order, you agree to these terms together with our Return and Refund Policy, Privacy Policy and Purchase Options Cancellation Policy.
The seller trades as Scan Cards and is based at 10 Downing Street, Cambridge, CB2 3DS, United Kingdom. You can contact us at help@scancards.co.
Nothing in these terms limits any rights you have under applicable consumer law.
2. Our products and service
Scan Cards sells physical NFC and QR cards that can direct a compatible phone to a web destination selected by the customer. Unless a product page expressly says otherwise, you link the card after delivery by following the supplied instructions.
Operation may require a compatible device, an enabled NFC reader or working camera, an internet connection and continued availability of the destination platform. NFC support varies by device. We do not control Google, Instagram, Facebook, LinkedIn, Tripadvisor, Trustpilot or any other third-party platform, and we do not guarantee that a third-party platform will remain available or keep the same features.
3. Orders and acceptance
When you place an order, you offer to buy the selected product and service. An automated acknowledgement only confirms receipt of your order. A contract is formed when we confirm acceptance or dispatch the goods, whichever happens first.
Please check the product, quantity, delivery details, price and recurring charge shown at checkout before paying. Contact us promptly if you notice an error. We may reject or cancel an order where payment cannot be authorised, stock is unavailable, information is materially incorrect, fraud is suspected or the order would breach the law. If we cancel after taking payment, we will refund the affected amount.
4. Prices and payment
The total amount payable at checkout includes the product price and any stated delivery charges and taxes. Import duties or local charges may apply to international deliveries where stated at checkout.
You must provide current and accurate billing and payment information and be authorised to use the chosen payment method.
5. Scan Cards Monthly Service
Where shown at checkout, your order includes a one-time charge for the physical card and an automatically renewing Scan Cards Monthly Service charged at $9.99 per month. The first recurring charge date and billing frequency are shown at checkout and in your order confirmation.
The monthly service continues until cancelled. You may cancel before your next renewal through the customer or subscription-management link in your order emails, or by emailing help@scancards.co. Cancellation stops future renewal charges. Amounts already charged are not refundable except where required by law or expressly stated in our policies.
If we propose a material change to the subscription price or service, we will give reasonable notice and explain your options, including how to cancel. We will not apply a material price increase to a consumer subscription without the notice or consent required by law.
6. Linking and acceptable use
You are responsible for choosing and maintaining the destination linked to your card. You must have authority to use that destination and must not link to unlawful, deceptive, infringing, harmful or abusive content.
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with the service or use a card to impersonate another person or business. We may suspend service where reasonably necessary to protect customers, third parties or the platform, investigate suspected fraud or comply with law. Where appropriate, we will give notice and an opportunity to resolve the issue.
7. Customer-supplied content and personalised orders
If we accept customer-supplied names, logos, artwork or other content, you confirm that you have the right to use it and give us a limited permission to reproduce it only as needed to produce and fulfil your order.
You are responsible for checking any proof we provide before approving it. Reasonable manufacturing tolerances may apply, but they do not allow us to supply goods that are materially different from the agreed description or approved proof.
8. Delivery and risk
Delivery estimates are not guaranteed, but we will deliver within the time agreed with you or, where no time is agreed, within the period required by law. Tell us promptly if an order is delayed or missing.
Risk in physical goods passes to you when you, or a person you nominate other than the carrier, takes possession of them.
9. Cancellations, returns and faulty goods
Your cancellation and return rights are explained in our Return and Refund Policy. Personalised goods may be excluded from the change-of-mind cancellation right, but this does not affect your rights if goods are faulty, damaged, misdescribed or not fit for purpose.
10. Intellectual property
The Scan Cards website, branding, designs and original content are owned by us or used under licence. You may use the website for lawful personal or internal business purposes. You may not copy, resell, publish or commercially exploit our protected content without permission.
Third-party names and logos belong to their respective owners. Unless expressly stated, Scan Cards is not affiliated with or endorsed by the third-party platforms a card may link to.
11. Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, for your misuse of a product, or for failures caused by a third-party platform outside our reasonable control.
If you buy wholly for business purposes, we are not liable for indirect or consequential loss, loss of profit, revenue, business, contracts, goodwill or anticipated savings, except where liability cannot lawfully be limited. Any business-liability limit must be fair and reasonable under applicable law.
12. Privacy
We process personal information as described in our Privacy Policy. Shopify and other service providers may process information to operate the store, take payment, fulfil orders and provide the service.
13. Complaints
If you have a complaint, email help@scancards.co with your order number and a clear description of the issue. We will acknowledge and investigate it within a reasonable time.
14. Changes to these terms
We may update these terms to reflect changes in law, security, our products or how the service operates. The version that applied when you ordered continues to govern that order unless a change is required by law or you agree otherwise. Material changes to an active subscription will be notified as described above.
15. Governing law
These terms are governed by the law of England and Wales. If you are a consumer elsewhere in the United Kingdom or another country, you keep any mandatory protections and rights to bring a claim in your local courts that applicable law gives you.
